You won't find the wording you mention the wording that begins with item 7 you have quote I your post anywhere in the POFA.
The relevant parts are Schedule 4 paragraphs 6-9. Start with the bit relevant to you. By this I mean, was there a NTD, if so was the NTK compliant with the relevant paras?
If there was no NTD, was the NTK compliant with the other paras.
Work through these to see if the NTK meets the very strict requirements. If they don't meet the timescales or don't have the correct POFA wording, they fail.
If they are relying on byelaws (and I believe CRAPCOA don't) then that is an additional point.

I've never seen the NTK or a NTD (notice to driver ?) that's because the V5 had an old address on so I assume things were sent to that address by the APCOA. Getting no response they used DRP to find me at my new address
So, because I've never seen a NTK or NTD does that make any difference ?
My next "payment" date set by DRP is tomorrow so no doubt I will be having more correspondence from them next week.0 -

How interesting, having not paid by the 2 deadlines set by DRP I have today received a letter, it gives a number of options
1) Pay in full by another due date
2) Pay in instalments if I can't afford it in one go, but there is strict deadline to agree to that
or the final option
DPR will recommend to our client that they appoint a solicitor to start court action........
So I guess this does show that DRP don't really have any teeth.
Now what's the betting the next letter I get will be from Gladstones, having read other threads too.
Any advice when that happens ?

Did you write after 25th May. If you did then they failed to treat the letter as a Subject Access Request. Send the letter again and tell APCOA that if they refuse a second time to supply your personal information you will complain to the ICO. Remind them the ICO can fine APCOA up to 4% of their turnover (which will make them even more of a financial basket case)This is a system account and does not represent a real person.
