The day finally arrived and, accompanied by my Lay Representative, the estimable Bargepole we turned up at Reading Crown court for our 11.30 hearing. After a short wait we were called and the oaths etc took place.
BP opened the proceedings by pointing out to the judge that the defendant had been six days late in submitting his WS. The judge then gave D a very rough time. I hardly said a word, and BP gently took D to the cleaners.
The judge then made his decision. My claim was upheld and D's ludicrous counter dismissed. My argument for unreasonable behaviour costs, some £400, was also dismissed in short order. A reasonably satisfactory outcome imo.
The thing that struck me was that, although the judge had only seen the papers ten minutes previously, he had grasped everything. I have met Government ministers with less acuity.
BP told me afterwards that he thought that the judge may have been more receptive to my unreasonable behaviour claim if I had agreed to mediation.

Any background TD? Or was that in another thread?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It was a property dispute, the claim was under Tort of Negligence. Basically the owner of a house which I wished to buy concealed from me a Home Rights Notice and I racked up costs on a survey and searches. He counter claimed for BOC where no contract existed.You never know how far you can go until you go too far.0

I had to look up what a Home Rights Notice was. Can't conceal stuff like that when selling property.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you CM, I think that the lesson we should take from this is that we should give mediation more consideration. The judge did not want to hear my argument about why I thought mediation would be a waste of my time.You never know how far you can go until you go too far.0

Mediation though, not so good against parking scammers.
There are still judges around who don't have a clue,
even more mediators who do not know what they are talking about0 -
No lesson to learn here for parking cases.
