Taken to Small Claims Court by ParkingEye

  • Hi. In point 3. it says "You must by 28th August 2018ncomplete the Small Claims Questionnaire (Form N180) and file it with the court office


    under that in a box it says " the County Court Business Centre, 4th Floor St Katharines House, 21-27 St Katharine's Street, Northampton, NN1 2LH


    As everything has been done online I thought I could do this online. Can I scan and email it to them?

    I'm sure that's ok, I've never seen anything previously which suggests this stage is by post only.

    See if anyone else can confirm too.

  • Everything so far has been done through Money Claim so I thought this could be done through Money Claim as well but reading now Im not sure Form N180 can be sent online and I cant find an email address for the County Court Business Centre to email the form to them



    Hope someone can help

    Send your completed N180 as an pdf email attachment to CCBCAQ@Justice.gov.uk

    You also need to send a copy to the Claimant.

    Is it in section "D" ABOUT THE HEARING. "D1" Hearing Venue?

    Yes if you are desperate to avoid a court hearing.

    You need to understand that this approach IS NOT RECOMMENDED BY US, and if you lose as a result, it will not be counted as a forum loss, because this is not the way to go.

    I was merely telling you this is something you *can* opt for if you absolutely categorically will NOT attend a hearing (why not?! that's when people win here!).

    And if you go for a hearing 'on the papers' you would need amazingly well written papers (witness statement and strong evidence - photos, and a video showing lack of visible signs in the same light - that potentially *could* win the case).

    Bear in mind the other side has a solicitor to prepare their papers and their argument will be possibly persuasive to some Judges, and not being there in person at a hearing means you can't put right anything they say, or disagree, or point out the holes (or even lies) in their WS. They get carte blanche to say whatever they want.

    And you'd need a lucky/anti-PPC court - which court is your local, not Manchester is it?

  • Romford is my local court. But I totally understand what your saying so somehow I will attend. It is a principle Im standing by so will make the court date somehow :)

    Picking holes in their evidence, at the hearing, and exposing the lack of cause of action/signage evidence, is a common winner!
