Damaged alloy wheel.

On Wednesday last I had two new tyres fitted at home by one of these mobile outfits.
During the fitting of one tyre to a brand new wheel, never been on my car and only purchased a week prior, said wheel was damaged. Probably by the tyre removal/fitting machine. It was only when checking the pressure prior to fitting that I spotted the two gouges along the outer circumference of the wheel.
I phoned them and was requested to send pictures via e-mail which I have done. They haven't yet responded. The wheel and tyre are not on the car and are in exactly the condition as on the day - ie. brand new and pristine except for the damage.
In this situation would I be entitled to be returned to the position I was in before the tyre was fitted? By that I mean a new, undamaged and unused wheel.
A repair would not achieve that. It would be a damaged and repaired wheel.
Would this be a different situation to e.g. buying a brand new car, t.v. etc., using it and finding a fault/problem? Then the seller could possibly be entitled to repair. This wheel has not been used, unlike the car or t.v., before discovering a fault.
Any suggestions would be appreciated.

I'd say expecting a new wheel (or a refurbished one in the same condition) is unreasonable.
Unless the "nick" is very obvious from a distance I don't think you can reasonably claim a replacement of the wheel.
Their T&C's will probably cover them for minor issues like this.0 -
Place local to me could refurbish the wheel for a lot less and its likely to stay in an as new condition for longer.
Maybe it was damaged putting it in the boot? Where does the jack and wheelbrace etc fit?Censorship Reigns Supreme in Troll City...0
