    So if I photograph the full NTK and include this as evidence in the POPLA, would this potentially get the charge nullified?

    Thanks for the help Redx and your patience. After this parking ticket I've given up on driving to work and started taking the bus (parking has gotten too expensive lol) so hopefully won't be happening again!

    you could do so, although the PPC evidence pack to popla should contain the NTK anyway (plus all their other documents)


    BUT, if you are quite sure that their NTK (the postal NTK to keeper of the vehicle, not their refusal of the appeal containing the popla code and their stupid interpretation of the law) does nt contain the POFA2012 warning paragraph that they MUST issue to a keeper with the Notice To Keeper (the NTK) then yes take a photo and add it to your popla appeal and save this appeal as a pdf, ready to upload to POPLA choosing OTHER when the time is right (when your appeal has been "approved" by the regulars on here


    sounds like they are OUT OF TIME to issue an NTK that contains the appropriate POFA2012 wording , so this issue must be one of the first of several popla appeal points, the others being NO LANDOWNER CONTRACT , POOR AND INADEQUATE SIGNAGE , NOT THE SAME AS BEAVIS , any BPA CoP failures etc too


    so failed to put the correct POFA2012 warning on the NTK


    not transferred liability from driver to keeper


    the HENRY GREENSLADE wording etc


    then the other points as well





    should be some recent SMART PARKING popla appeals or similar that you can crib from where they failed on similar grounds, so look at the POPLA DECISIONS sticky thread for anything where an assessor upheld the appeal on POFA2012 failings

    Are you sure? I didn't ask for the bit your quoted to me. I asked for the section nearer the bottom that talks about keeper liability/28 days from the date the PCN is served.

    What does that bit say?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
