Just a quick scan - and a few edits you need to undertake (and I may not have picked all of them up) to give this proper credibility.
I am in receive of your letter dated 11/6/2018, with ref: XXXXXXX
    receipt
24/4 APOCA responded back confirming they do not work under POFA.
    APCOA
I responded with a letter confirming the receive and pointing out the above again and the law is clear as they have no right to pursue the keeper .
Not sure what that means? Try re-wording.
7/6 an appeal to POPLA was lodge and the above breach of several laws and code of practice was pointed out.
    lodged
13/6 a correspondence from POPLA stating the following " APCOA Parking have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge. " and APCOA portal indicate this also.

Nope - it's ZZPS. Get that name right as a minimum.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Thanks all for the reponse
  • Dear All:

another update, i had BPA response today stating the following " APCOA Parking have confirmed that the charge was erroneously escalated to debt recovery stage earlier than it should have been. In view of this, by way of rectification, APCOA Parking have cancelled this Parking Charge Notice."

i feel it is just inappropriate that they just closed this based on the above, however it does mean no need to worry about them asking for the payment

    regards

You are right, how many more times is this happening
    to unsuspecting people

Of course the BPA is fast becoming the next trade body
who turns a blind eye to the scam

    what an answer !

whilst this was at POPLA they are supposed to seace actions , IE put things on hold , not continue

"earlier than it should have been." , YUP after the POPLa result , not whilst one was taking place

This is the standard BPA line. A cancellation seems to fix everything.

The BPA code of practice prescribes sanction points for such non compliance, but of course the PPC's magic words; "it was an admin error" is accepted and it's all pushed under the carpet!

But this bunch of scammers have divulged private information to a third party with no reason or authority.

I would be fuming, and taking it further just for revenge if nothing else.

Agreed fisher ... but does this not prove that the BPA has
no place in the industry ? They have themselves dropped
    into the sewers

"British Parking Association" ..... WHAT A JOKE
