Solicitors Forms?

OK, I wonder if anyone can help me. The standard forms that solicitors offices use, are they all different. Basically, a solicitor has sent me a sellers property information form which when I sell, I am supposed to fill in and pass over to the purchasers solicitors. It asks which fences are ours etc. If there are any disputes with the neighbours. I want to know if they are all the same or whether each solicitor has his own form. Basically one question is not quite worded how I would like. It reads, has the property or its garden ever flooded. Now, the house has never ever flooded and I don't mind answering that question, BUT the house is built on an old Marsh and so we have a back garden with quite rich clay soil. Now this means it is not in any way a flood plain but the garden takes a little longer than some to drain away after heavy rain. The long and short of it is I don't want to be asked about the garden, I just want it to read, has the property ever been flooded. Would a different solicitor have forms with different wording?

    Unless we are talking days for the garden to drain or you have put in an insurance claim for flooding at some point, I would just answer no to that question and move on :D

    I have a heavy clay soil in my garden which takes a few days to drain but I answered no on my form because it doesn't flood - it just takes a few days to drain!!!!

  • "Flood" or "Flooding" has a legal definition, there are plenty of law cases out there, mainly to do with insurance claims, that will say something to the effect that a flood is inundation over a large area, normally associated with rivers breaking banks or the overflow of (storm) drains or water courses.

    It is generally accepted therefore that flooding of a property relates to water coming onto the premises from outside the area due to a water escape from the usual bounds of a river or watercourse.

    A 'flood' is NOT water gushing from a burst domestic pipe within the home, nor is it saturation of the garden through heavy rainfall.

    If the area in which your home stands has never been flooded in the 'disaster' sense above, answer NO to the flood question.

    To answer your question regarding the forms, yes they are all the same & are to law society format.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.
