It took a while, but we had the hearing this morning.
Gladstones did not turn up. They had written to the court quoting CPR 27.9, stating that they might or might not attend, which the judge was not impressed with.
He decided to strike the claim on that basis, but also made mention of the fact that the evidence presented was insufficient to prove the existence of a contract. He did not get much into the matter, but overall expressed his dissatisfaction with Gladstones paperwork.
I asked to be granted costs under CPR 27.14(2)(g) on the basis that the claim was unreasonably made and without merit. He hesitated to start with, but agreed to my request, awarding of 12 hours at £19/h, this in addition to £95 for the day and travelling expenses.
The forum has been invaluable in gathering information.
