I have just seen this post. I trust this matter went away? I have never heard of the scenario portrayed above. I would suggest it was a surveyor driven dispute. Did your neighbours actually care enough to pursue this? Was there an actual 'loss' to them? I think it would be so hard to take this further, and given the lack of activity on this forum, hopefully the matter just disappeared along with the difficult surveyor.
It must have been very stressful! You should have received reassurance from your party wall surveyor.0
