Car Insurance queries

My husband and I have been isured with Direct Line the past few years.I am the registered keeper of both our cars.Earlier in the year, some guy hit my husband when he was in my car.My husband is a named driver on my policy and I am on his.He claimed against this guy and the claim is still being processed.
A few questions:

His policy is up for renewal.Does he have to declare that he made a claim in the last year as the accident was not in his car he wants to renew????:confused: Also, is it ok to swap over while a claim is going through? And his no claims are protected on his policy so does that mean they are safe?
