This gets better and better....
I knocked on the vendors door and asked if she received my bid. She said she did. I asked her how much she sold the property for out of curiosity expecting the bid much higher.
She said the house sold at the asking price as Haart explained that the banks and surveyors wouldn't agree with the bids that were in excess of the guide price due to the work needed doing on the house. EA said to her the kitchen and bathroom needed redoing. Meaning it was more than likely their mortgage would fall through as they wouldn't have a surveyor or mortgage lender to support the higher bids...the higher bid was 13k over mine was 8k over.
The vendor and I didn't agree. So the person who offered the guide price got it. The vendor was clearly shafted.
I called haart to explain I was going to report them to the ombudsmen, low and behold I received my first ever call back from them.
He explained that I put them in an awkward position talking to the vendor. I told the EA it was wrong for them to trick an old woman into thinking she wasn't going to sell the house at a higher price. He disagreed and said she was misunderstood the information given to her by the EA and how I was better off giving the guide price.

They do have a point in that any ammount over the valuation will be an additional part paid in cash and not part of the LTV. Still it seems they were manipulating and confusing her.I called haart to explain I was going to report them to the ombudsmen
