Parking eye

Hello,

Any help with the below matter would be greatly appreciated.

I parked in a parking eye car park (my doctors surgery) for under half an hour and for some reason I have now received a county court claim.

I have proof from my doctors that I was in the doctors at that time but I must have forgotten to input my registration plate or the correct one.

I have spoken to parking eye and sent them a letter with proof of me being at the doctors in their car park at the time I was in the car park but they rejected this and told me to “deal with the courts”.

I have filed acknowledgement but need to serve my defence within the next few days, can anyone help with this?

    What's wrong with adapting the ParkingEye defence example in the NEWBIES thread post #2, which is recent and is all about the lack of obvious iPad/keypad in an Odeon car park?

    Have you spoken to the Doctors surgery about this?
    if so what did the surgery say, and what did you say to the surgery?


    Assuming this car park is part of the Doctors surgery and for patients visitors and staff of the surgery
    From the Plain Language Commission:

    Yes it is the doctors surgery car park.

    The doctors surgery have been fairly dismissive and not helpful - they just want to stay out of the matter.

    You absolutely categorically will NOT be able to use the forum properly unless you look on a PC or laptop, there is no quick fix to learning how to defend a court claim.

    You should be working on a defence as outlined in the newbies thread, however you should also be getting in touch with the doctors surgery again.

    What did you say to them??

    The NHS parking principles are quite clear that the Doctors surgery is/are responsible for the actions of the parking company

    Contracted-out car parking

    NHS organisations are responsible for the actions of private contractors who run car parks on their behalf.
    NHS organisations should act against rogue contractors in line with the relevant codes of practice where applicable.
    Contracts should not be let on any basis that incentivises additional charges, eg income from parking charge notices only.
    Dear NHS doctors surgery, re parking charge notice ##### issued by your agents, parking eye. On (date) my vehicle was parked in your car park, while i visited the surgery. I was surprised to find that i had received a parking charge notice from Parking eye, and even more surprised to find that you are unwilling to assist in resolving this matter (instructing parking eye to cancel)

    Parking eye have now issued/commenced action in the county court in order to attempt to recover this unjust parking charge notice.
    I'm sure that you are aware that you, as principal are liable for the actions of your agents, and this is made quite clear in the N.H.S parking principles which clearly state the following
    "

    I am now having to prepare a defence as a direct result of you allowing parking eye to operate in your car park, which is causing a great deal of stress and anxiety, and in light of all the above I am requesting you to take immediate steps in order to cancel this parking charge notice.

    Also please provide the following information:

    Who collects the money from parking charge notices?
    How much do you pay parking eye for so called parking management, or is this 'service' provided free of charge?
    What safeguards are in place to ensure that the activities
    of parking eye are regulated and controlled?
    What safeguards are in place to protect patient confidentiality, in cases where a driver may not be the registered keeper of a vehicle, and does not want the registered keeper to know they have visited the surgery on a particular date/time, in the event of the vehicle getting a parking charge notice?
