    Brief report of the day:

    Got up early to run over my defence and witness statement - I was nervous about my actual statement as I had struggled to get replies on this thread with some detail so I wanted to know everything inside out as recommended in the Newbies thread.

    I arrive at court 30 mins early and spent the time looking over my notes and practising in my head what I was going to say. 20 minutes had gone and there was no sign of The Claimant, I continued reading. I was pretty sure they wouldn't turn up at this point which knew that I was in a good position as long as I could articulate my points properly.

    I was called into the court room and the judge let me know the claimant had decided against attending and would rely upon the evidence provided in their witness statement. He went through their reasoning and why they believed they had a claim and also the evidence presented. He then asked what my defence was: I started with the fact they didn't have a document with landowner permission, moved onto the fact I had permission from a resident and how ridiculous the system is of having 40 permits then needing to buy more with no alternative, then onto the poor signage and not following the IPC guidelines which they claim to have been audited by and finished up by saying how difficult they have made the process by not providing me with information and the costs are ridiculous and inflated.

    The judge then reiterated all the points from both myself and the claimant and ordered that the claim be struck out!! Huge relief when he said those two words! - He basically agreed totally with what I said - no landowner permission, not following IPC guidelines or providing alternatives when residents ran out of scratch cards, signs being illegible and regardless of all of that the costs were inflated and unfair.

    He asked about my costs and have me loss of earnings,travel and parking but didn't agree the claimant had behaved unreasonably so didn't provide the additional costs.

    As I was leaving he did ask if I have experience in law and how I managed to write a WS better than the majority of lawyers he sees in his court, he suggested if I was looking for a change in career law might be for me!!

    Overall a huge success!!

    Well done to you - another one bites the dust!

    Now use that win to communicate with that MA, saying that a Judge at xxxxxxx court on xx/xx/18 declared the '40 visitor permits then buy more' unworkable and that their parking contractor lost the case. As such, since the MA's first duty is to the landlord & residents, not favouring their scumbag parking firm, they need to decide on a fair alternative rather than allow their agents to keep scamming visitors and restricting visitors and deliveries to well under one a week.

    Or, remove them completely from the site as there is no need for any parking contractor in a residential car park.

    Good case .. Gladstones screwed it up for their clients PCM (UK)

    Shows these parking companies should not go on the cheap

    If they don't pay up within the specified time period, you simply send in the bailiffs. It costs (i think) about £100 to do so but it's added to the debt and you will get everything back.

    Pretty much yes! Ok thanks, I will do that if I haven't received payment. I still haven't received anything in the post from the court of the judgement is this normal? No word from PCM UK but that's as expected.

    Be careful in sending in the baillifs. Give them a nbit of time to pay.

    I have a case with the Ombudsman at the moment complaining about a DJ who stayed a writ I had taken out, (cost me £66) , without consulting me, and not replying to the three letters I have written to her.

    Even County Court Judges must watch their backs when thee Deep is around.
    You never know how far you can go until you go too far.

    if the witness who signed the WS is not there, can you not ask for an adjournment in order that you may cross examine him/her?

    Some of these PPC WSs seem very dodgy indeed. I believe that, a few years back they wee being signed by the cleaning lady.

    Ok will do, thanks. Sorry to keep asking this but do you know if I should receive a letter from the court with the decision etc? I have nothing in writing as proof at the moment.

    Also I am a bit confused by your second post?

    Yes you should get a copy of the order of the court; maybe they are a bit behind on typing up judgments. You could ring the court.
