GDPR and parking tickets

As the registered keeper of my car, I have been issued with a Parking Charge Notice from Britiannia Parking for overstaying in the supermarket. It states that the driver of the vehicle is required to pay this parking charge in full. It then goes on to state 'As we do not know the drivers name or current address, and if you were not the driver of the vehicle at the time, you should tell us the name and current postal address of the driver and pass this notice to them for payment'. Given the new GDPR do I legally have to pass on the drivers details, and what if the driver refuses their permission to let me do so?

GDPR or not, you have no obligation to tell the parking company who the driver was.

To be clear... do not give away the driver's identity.

Britannia are just a joke scammer.

    It's a phishing attempt ... it's a con.

They have the keepers info of the car and that is all
they are legally entitled to from the DVLA

They are correct in that they don't who the driver is
and you will NEVER tell them

We can only assume they are copying UKPC who also
    come out with this rubbish.

If you have receipts from the supermarket then complain
to the CEO and request it is cancelled ..... if they want
you to continue spending money with them.

PPC's like Britannia installed by supermarkets is a sure
fired way to reduce their profits
  • Thanks - and legally they can do nothing?

Don't be confused about parking scammers and a
    normal company.

If you don't get this cancelled by the supermarket then
you can expect driffle type letters from idiotic debt
    collectors which you completely ignore

I guess you have not yet read the NEWBIES FAQ sticky thread.

Read that and you will find all the information you need to combat this - including a full explanation of why you should never reveal the identity of the driver.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

[STRIKE]Legally[/STRIKE] Lawfully they can take the Keeper to court, but have to jump through many hoops first. The best thing to do is read the Sticky thread for NEWBIES, and send the appeal template you will find there before the appeal deadline if your complaint to the store manager/CEO doesn't work.

    Easiest to:

    - read and follow the template (tried & tested) appeal system in the NEWBIES thread,

    and

    - search the forum for Britannia to read loads of others, I replied on one earlier.
