RJ, you really need to speak to your Doctor. Give them a phone Call Monday and ask for a call back. They will arrange a phone appointment with you, where they will call you at an arranged time, where you can discuss your situation.
Hopefully your Doctor can refer you for an assessment of your health and you can then receive any help you need.

Yes write a diary of your day to day activities, but that is not enough for a mandatory reconsideration or tribunal. Both DWP and tribunal are going to want to see an alternative medical opinion, which is why you should speak to your Doctor.The comments I post are personal opinion. Yeah, i plan on doing that im gunna ask my doc to write a letter explaining in detail why he medically thinks the decision is wrong and any medical files, also get a letter from a family member who knows what im like on a daily and my friend/helper who can explain how am and was in the times we spent together during my probation..
Okay, so my agoraphobia is caused by something bad that resulted in me going to court which ruined my life. I bottled telling the asseser cause my helper was unable to come in and talk about it on my behalf after making us wait an hour.. I have mentioned court but not the offence due to being anxious and scared they wouldn't take it professionally and give me a bad decision out of hate.. I can get evidence too from my court case that goes back like 3 years ago. Can i explain things that i bottled up at assessment in my reconsideration letter with evidence to back it? Like court dates and the offence?. This is why i feel i would win a proper hearing too.. also going to ring up dwp and ask for a reasoning letter and a SA85A form. Also any new evidence i send will that go to the tribunal or would i need to send same copies.

Unless the person that went with you to the assessment is your appointee, then it would have been doubtful that he could have spoken on your behalf. Yes, explain how your condition affects you in the MR letter but keep it straight to the point, without wondering off onto something else. You need to concentrate on that reg 31 (reg35 ESA).
Anything you send to the DWP as evidence will be sent to the Tribunal, if you get that far.
Asking for a copy of the assessment report would be helpful but time isn't on your hands and you may not receive this in time for the MR request letter to be sent. Not sure what the SA85A form is, sorry.0 -
The suggestion of a diary was that you could take it to the tribunal hearing, and then use it to remind yourself of examples, how a typical week / month is like when giving your verbal evidence. A kind of memory aid really.

Surely it wont take over month to receive a letter explaining why im not entitled. When i ask for the reason why letter it gives me another 14 days apparently. I got my decision friday just gone so i should be okay. And my helper was my probation officer and i needed him to explain the court and offence but anywayway a SA85A form is the report the health asseser does mate so you got it spot on.
Im just so anxious and worried. I feel like waiting just under my deadline then appeal for a MR on phone and fail it on purpose. Instead of rushing and causing myself stress tryna get/waiting for evidence. If getting them to change their mind is as impossible as people say in a MR surely i should just focus on prepping for court. Without the rushing about the first month may give me more time to see a therapist and get more evidence i can send after asking for a hearing. What do you think?0 -
That is your choice. No harm in contacting UC advising that you will be applying for Mandatory Reconsideration, but need time to obtain letters from Doctors etc.
I am not sure the one month is strictly applied, as claimants really have longer than this, if they can supply evidence of why it took longer than one month. I.e. If it took time for your Doctors to supply their own letters/reports on your health.
A tribunal can take many months before your case is heard. So if you can go through MR properly, that would seem sensible.The comments I post are personal opinion.
