HighView Parking awaiting appeal rejection

Hi

Thankyou in advance for any assistance given.

On the 31st March this year my vehicle not me driving and not naming who, over stayed in a car park alerting Highview parking via ANPR. Highview never sent me a charge notice till 20th April. I received the notice on the 23rd April and appealed their notice that day on the grounds of failing to comply with the requirements of schedule 4 Protection of Freedoms Act 2012 section 9 (5) The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.

I then received an email from them on the 15th May saying they have 7 months to issue PCNs and to forward drivers information. It never stated a refusal of appeal or a PoPLA code.

Today 8th June I have received a charge notice reminder. I’m sure I should just ignore said reminder however how long do they have to deal with my appeal? Should I chase this up?

I am aware of a number of other vehicles fined on the same day who had their appeals accepted quickly due to the late arrival of notice should this be relayed to them in any future correspondence?

Thankyou for your help

Regards

James

Everyone is politely asked not to post here until after reading the newbies FAQ thread near the top of the forum

Go there now to learn about the game you are now caught up in and how to deal with it
  • Thanks for your reply I have had a read, however I have been unable to find any information on how long Highview have to reply to my appeal and actions on them not replying. If it is there is it possible to be guided to where.

    Regards

It's in The British Parking Association's Code of Practice:
22.8 You must acknowledge or reply to the appeal within 14 days of receiving it. If at first you only acknowledge the appeal, or your reply does not fully resolve it, normally we would expect you to seek the additional information you require from the motorist and accept or reject the appeal in writing not more than 35 days after the information required to resolve it has been received from the motorist. It is acknowledged that in exceptional circumstances, an investigation into a appeal may take longer than 35 days after such information has been received and in these instances the motorist must be advised accordingly and given a date by which they can expect a resolution. If this date cannot be achieved then the motorist must be written to again and a revised resolution date agreed. We may require you to demonstrate that you are keeping to these times.

see the NEWBIES thread again , you report them to the BPA and a brief timeline of events , including the date of the appeal and enclose copies of all paperwork , especially if more than 35 days have elapsed

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
