    I have spoken to him today and he ensures me that it is only wanted for a play area for his kids


    What did he reply when you asked that if this was the only reason, why he was so opposed to just renting the land rather than buying it?

    I still smell a large rat here, but I hope I'm wrong. Let's be honest, he's not doing it just to help your mum out. There is something more in it for him than just 'an area for his kids to play'.

    Have you encountered modern kids?
    They don't need room to play.
    They just need a games room or even just room to stretch their arm long enough to move their screen far enough from their eyes to view it properly.

    Our lad and his friends love the outdoors and are happiest when they're at the top of some tree or other (or getting wet in a river). There are plenty of kids who want space to play.

    He will have to go to some expense to get it sorted out for what he wants, fencing, turfed, putting in a separate gateway and then there is the work itself. if something happened to my mom in the short term and she wasn't around anymore he would have done it all for nothing, i can see his point to some degree

    I appreciate the concern :) :beer: and if everything does go's to !!!!! ill be back
    his children are very young at the moment so he wants somewhere safe for them to play as his property if next to a main road and just has a small garden so again i can see his view on things,
    In 10 years time when they have grown up things could possibly change that why it will be important to have the uplift clause included .
    Thanks to this forum and the people replying i had never heard of that clause so im glad i posted.

    There are exceptions to every rule. The places where I used to play as a child 60 years ago are still accessible to me, but there are no obvious pathways through there now. It's not used as it was when we made dens and fished etc away from adult ken.

    And I blame the adults. At some point, it all became very 'dangerous.' Far safer to have your child tucked away in their bedroom or the back garden.....except on-line isn't necessarily safe.

    Life skills? Oh yes, how to find a cheat to get to the next level!:rotfl:

    The uplift clause you mention will be fine for this particular neighbour, but if he sells in the future, this clause could be removed. If you speak to a legal bod, make sure the words "successors in title" are included in the clause!
