Hi Everyone!
Iv been trying to find answer for my question but unfortunately I can’t find it anywhere, Im hoping somone can help me.
Iv been off sick since April 2017, Im still employed by the company. I asked my employer in December to pay out my my annual leave money, at the time I was told it cant be done before end of the tax year, I accepted it and waited. I start claiming universal credit on the end of february. When It come to end of the tax year my boss informed me I have to wait untill 23th as that is the wage payment day and it will be sended to me. It wasnt untill 26th of April. Today 7th of June I been informed by Universal Credit that I erned to much and my universal credit payment is £88! I explained them that Im off sick and I wasnt in work since last year and that is my annual leave entiltment! I informed them that I staright way pay my debt off and dont even have that money. I been informed that I need give themof evidence that is my annual leave money, I do have proof of bank statment and payslip saying is holiday entiltment. I have to wait 6 weeks for them to make decision! Thats mean im left with £80 for next 6 weeks! Iv been try to find do they can reduce you payment because of annual leave entiltment? Do is any way I can speed up that 6week process? Do any one know any law regulations regarding my situation? Thank you for help!

I!!!8217;d imagine salary is salary, AL or not. AL is basically 5 weeks pay so I don!!!8217;t see why it wouldn!!!8217;t affect UC0

Even though it's annual leave money that is owed to you, it's classed as income for UC purposes.
Do you have any family that can help you right now?0 -
My annual leave that was paid out to me was equivalent of 46h not full anuall leave like you suggesting.0

@poppy12345 no I dont have any family, so I no one to help me.
So if I recived tax return it would be deducted from my universal credit?0 -
Counted as earnings when the money is paid to you. Does not make any difference whether it is annual leave money from last year. I can't see a decision maker deciding in your favour and agreeing to ignore this income, so you receive additional UC payment. But you will have to wait and see. A letter from your employers explaining the circumstances might help.
See whether you can get a budgeting advance and that may help you a little while you wait for a decision. The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -

Yes counted as income when tax rebate paid to you.The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. @paddedjohn Im not reciving SSP as its only for 26 weeks Iv been sighn off sick May 2017. My SSP run out in November but even then my employer didn!!!8217;t aloud me to take my annual leave (that was three months before I start reciving Universal Credit) untill end of tax year. In that three month waiting for Universal Credit to be awarded I got into lot of debts. And now because my payment got reduced I can!!!8217;t pay my rent or any bills Im getting in much more debt. I have no family to help me or friends (since diagnosed with depression everyone just cut them self off me). Thanks to Universal credit payment cut I will loose my house of 5years and I will have to get official bankrupt. Universal Credit destroys peoples.0
