Clean Break Order with Joint debt

I have recently finalised my divorce but now I need to sort out Clean Break Order. However me and my ex have a joint debt of £45,000 resulting from negative equity from selling house after the break-up. Since this time I am am the only one paying off some of the debt and my ex refuses to pay!!! I have requested that the debt is split into 2 so they can chase him as well (he is financially better off than I am!) but I’m not having much joy with this either.

Can anyone advise me on what to do? I was told that the Courts tend to deal with assets rather than debts :(

    Joint mortgage? Jointly and severally liable then. I am not sure a court can overrule that but speak with them and see what they suggest.

    If your ex absolutely refuses you pay you have the choice of either picking up the tab (and effectively letting your ex off the hook) or also refusing to pay and suffering the consequences of a damaged credit file and being pursued for the debt.

    I appreciate that sucks but it is the reality of a lot of joint liabilities. Maybe if you do stop paying and you ex is impacted by the consequences he may have a change of attitude - particularly if he needs to take out another mortgage anytime soon!
