PCN payment - Handling/Processing Fee

Hello all,

New to this forum and hoping your great advice can help me with a query.

Is charging a £2.50 handling fee for paying by card (Credit and debit) enough grounds to have a ticket quashed? This practice was outlawed by the UK Government on January 13th this year.

My view is that as these payment terms are not legal, the issuance of the ticket and hence it's validity aren't legal either.

Any advice appreciated.

Than you.

Complain in writing to you local council Trading Standards Officer, avoid CAB or Consumer Direct

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

Thank you for the reply. I'll be doing all those things.

In your opinion, does my specific case look like a valid appeal based on the circumstances of the illegal handling/processing fee demand?

    Thanks

Everyone is politely asked to read up on this in the Newbies FAQ thread near the top of the forum before starting a new thread

Go there now to learn about the game you are now caught up in and how to deal with this.

See #2 for advice on how to deal with a lbcca (if that's what you have received), and how to prepare a defence.

Your point about the fee would not be enough to get any court claim dismissed

Throughout here you are advised never to reveal who was driving.

You need to edit your op to remove details of who was driving

If you have used your real name in your post then remove that.

The ppcs monitor this forum and can use your posts against you
  • Thank you Quentin.

    Original post edited as advised.

    Thanks.
