Parking Eye Aldi - Unsuccessful Appeal

Hi All,

I Recently challenged a PCN from ParkingEye using the template appeal form for 'BPA or IPC members' in the Newbies FAQs. The incident was at an Aldi car park in Kingsbury, London. I had genuinely gone shopping there but forgot to input my registration in the stores system. I paid in cash so there is nothing from Aldi on my bank statement and the receipt was thrown away.

What are my options now? I received this email from ParkingEye:

Dear Sir / Madam,

Thank you for your correspondence in relation to the Parking Charge incurred on xx/xx/xxxx at xx:xx, at ALDI Kingsbury car park.

We are writing to advise you that your recent appeal has been unsuccessful and that you have
now reached the end of our internal appeals procedure. This is because you have not
provided sufficient evidence to show that you did not break the terms and conditions on the
signage. We are fully compliant with British Parking Association regulations on signage, and
confirm that there is adequate signage at this site that is visible, appropriately located, clear
and legible. Please be advised:

There is an independent appeals service (POPLA) which is available to motorists
who have had an appeal rejected by a British Parking Association Approved
Operator. Contact information and further information can be found enclosed. See
also [/url]

As a gesture of goodwill, we have extended the discount period for a further 14 days
from the date of this correspondence. If you appeal to POPLA and your appeal is
unsuccessful you will not be able to pay the discounted amount in settlement of the
Parking Charge, you will be liable to pay the full amount. If you have already paid the
reduced amount, the Parking Charge will be increased to the full amount and you will
be liable to pay this increase.

By law we are also required to inform you that Ombudsman Services
[/url] provides an alternative dispute resolution service
that would be competent to deal with your appeal. However, we have not chosen to
participate in their alternative dispute resolution service. As such should you wish to
appeal then you must do so to POPLA, as explained above.

[/url] or by posting a cheque or postal order to ParkingEye, PO Box 565,
Chorley, PR6 6HT.

You have received a parking charge notice, the Operator did not accept your representations
and you now want to appeal.

4. I was not the driver or the registered keeper of the vehicle at the time of the alleged
improper parking
5. Extreme circumstance prevented me from parking correctly
6. Other

    Well the scammers will say that ... won't they ?

    Let it go to POPLA and even if that is rejected, it appears
    that as it's Aldi, PE will not go further

    MUI that Aldi take a dim view of this behaviour and will cancel if adked, but PoPLA costs PE more so go to PoPLA.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    I did and Aldi got PE to cancel the charge.

    On 25 May 2018 I parked in Aldi, Leek and bought some items. My husband and were on a long and tiring trip from our home in Bristol to family in New Mills, Derbyshire. I have mobility problems. We did not know there was a terminal system in the Aldi car park as our local Aldi in Bristol (in which we shop 3-4 times a week) does not have such a system. We have never overstayed in our Bristol Aldi. I parked for less than an hour in Leek.

    As a regular customer I am sure Aldi does not want to alienate its customers. Surely the parking system is there to deter persistent offenders. I am asking you to rescind the charge as it was an honest mistake.

    Not qualified to speak for Mumsnet.

    But this forum never says ignore a popla appeal!

    And also advises from day 1 to complain to the retailer/landowner etc!!

    Hi, my Dad has been hit with the same problem at this same car park, only that he actually kept his shopping receipt and used it in his appeal and got rejected with no reason other than "insufficient evidence provided"! :mad:
    Did your email make any difference? What was the outcome?

    Parmar, the PPCs generally DO disallow appeals. They are hoping people will give up at that stage.

    You need to read the Newbies' thread and then start your own thread if you need further assistance.

    Please note: TheMikkster states that the PCN was cancelled by Aldi. Way to go .... ASAP.
  • These guys are not that bad as a parking enforcement company. I appealed my penalty notice by sending them my receipts and letting them know it was a genuine one off mistake that I didnt know i had to enter my car reg details and that i was a loyal aldi customer and they emailed me the same day  i put the appeal in and said as a gesture of good will they would cancel it on this occasion.

    If this was a penalty charge notice then you are dealing with a council parking ticket, there is an important and critical difference between a parking charge notice and a penalty charge notice
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

    I sort of agree but not fully.  ParkingEye cancel lots of cases - that is a good thing.

    But they overuse and abuse ANPR and it is unreliable, predatory and bloody well not needed in most places.  A bad thing.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
