They say it’s fair

I will keep this brief, I own a salon and have staff. I have always paid for 4 parking spaces ( 13 years) last year we had new landlords and recently they have employed flash park to monitor car park. I was issued with four permits.
So every time some one parks they have to come in and get a permit to place in their windscreen ( takes about 5 mins)
Now you know what I am going to say....... one of my staff whilst getting permit was photographed and has fine. She was told by her father to ignore it so she did.
Now she has come to me with letters threatening court action. This is flash park.
I have spoke and emailed my letting agent who has said I need to speak direct to flash car park and he can not deal with it. But their system does not work. They have agreed they will give us 5 minute window to get tickets but what about my poor staff member she is a teenager in apprentice wages - this is not fair - any advice would be gratefully received

    3 other things to add

    flashparks are BPA , therefore GRACE PERIODS apply , and 5 mins is just not good enough

    flashparks is the self ticketing arm of vehicle parking solutions , self ticketing as in one of your neighbours is getting monies everytime he/she takes a photo

    We did, briefly, consider using their self ticketing service a while ago. And, please, I don't need a lecture on or advice about the merits of this. There was nothing when we were discussing it about commission.

    Indeed, their FAQs seem to rule it out.

    It was just that their FAQs say they don't and we were clear we wouldn't get (and didn't want) any payment.

    Both the IPC and Bpa, ltd codes of practice allow for 10 minutes grace period, and and as such the ppc should not be ticketing at anything under this, let alone accessing and processing your personal data.
    Whoever took this company on will be jointly liable for the actions of its agents (the parking company)

    But do they actually clamp themselves?

    I can only go on my experience and their Q and As. And I haven't been able to find anything online to indicate they pay commission

    Have you got a link to confirm they do? Particularly to neighbours which you reference in your first post.

    others will comment , but the BPA banned commission on new services

    are you ADAMANT that no representative of flashparks is on the land , in van with livery , and in uniform at the time tickets issued?

    She'd be their very first. It's not going to happen over an £85 PCN. Would cost the PPC probably three times that amount to recover it.

    only the landowner or managing agent can hire companies like this

    nowc dependent of your relationship with new party , ask THEM to get ticket quoshed , if they deny / refuse then fire off letters , firstly a SAR , where the "villain" will be revealed , then one to the BPA , complaining that this company have entered new contact on self ticket / commission basis
