Council parking appeal

Hi need advice.

Got a windscreen parking ticket for being parked on the curb out side my house by the Barking and Dagenham council.
I done the informal appeal that was rejected today.

My appeal was that my car had broken down, I had the power steering hose blow clean off the pump as I was turning of my drive. I got stuck across 2 lanes at a small junction opposite my house so pushed the car back onto the curb to clear the road. This obviously was in a straight line without steering.

I straight away went back indoors to call breakdown to get it lifted to a garage for repair. Approximately 20 mins later I saw the ticket fellow putting the ticket on my car. I told him it’s broken down and I was waiting for recovery.

In my appeal I have supplied evident confirmation of the time and date I reported breakdaown and supplied evidence that the car was recovered by breakdaown within the hour.

I now have the opportunity to pay the reduced rate or make a formal appeal.

I still have not received the letter explaining why the informal appeal was rejected just an email stating it has been and a letter was sent 1st class on the 1st of this month.

    So it looks like I should be in the clear as I!!!8217;ve provided evidence that I had broken down and was awaiting recover before the ticket was issued.

    Don!!!8217;t understand why they have rejected my appeal then.

    So do I have to wait for the NTO to arrive to appeal formally?

    I really don't know, what does the Council website say?
    You never know how far you can go until you go too far.

    As we tend to major on private parking tickets here, PePiPoo will be your best bet for council tickets. Register there (but please note that a hotmail address won't work) and post a new thread; here's your link:

    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

    PePiPoo has an excellent success record in dealing with council tickets.

    Good, and that's the stage it will be won at, or adjudication.

    DO NOT PAY. IT'S A BRIBE NOT TO APPEAL FURTHER. TAKE THE LEAP OF FAITH NEEDED!

    Good. That helps because if they do not show their consideration of your appeal points, they have committed a 'procedural impropriety'. And that adds to your appeal points for NTO stage (do not tip them off now).

    As long as YOU are the rk of the car at the DVLA, wait for the NTO if the first one was a PCN on the windscreen (only 'informally' appealed this far). You will win at the later, formal stages.

    Councils routinely decline the informal appeal because:

    - lots of victims, naive people or idiots with more money than sense, pay at the discount, assuming their case is shot down

    - it saves them admin spent on even thinking about the appeal

    - the informal 'decisions' are often made by the private firm that issued the PCN!

    NTO stage is different. No asking what NTO is, you should take this to pepipoo:

    They win almost all cases there. You MUST post pics of the PCN (both sides) and MUST NOT use a hotmail email addy to register.
