Hi,
I'll try and keep it as short as possible.
We purchased a new build house from Linden homes about 4 years ago. We have a rainwater harvesting tank system installed by Linden on building it which flushes our downstairs toilet. Towards the end of last year the pressure tank that pumps the water from the tank to the toilet completely rusted through and flooded our garage. I contacted Linden to inform them but because we were outside the 2 year warrenty we were advised sorry they can't do anything. I then contacted the manufacturer of the tank to ask if they would expect their tank to last longer than 3 1/2 years and on investigating the issue he informed me the wrong tank had been used and installed. The tank we had isn't lined properly to cope with oxygenated rain water. They have a completely different tank which is lined properly for a rainwater harvesting system and wouldn't rust through.
So I contact Linden again fully expecting them to sort now as I have proof the wrong tank was sourced and fitted but the response is simply nope sorry it's outside the 2 years warrenty. I am shocked by this as Linden are at fault and the product supplied is not fit for purpose.
I want to take this matter further as I feel Linden should be under obligation to rectify this matter for us but don't know who to turn to or what to do.
Do people think I would stand a good chance of winning via small claims court?
