PARKING EYE, tower road Newquay.

Sorry for another thread about tower road but none seem relevant to mine. I pulled into the car park next to the golf club and it said private parking so I drove towards the right hand side of the building and into a pay and display car park (parking eye) I tried to pay but meter wasn't working (I have a photo) so I paid buy phone and have a bank statement to prove. I wasn't late or anything but they've sent me a £100 fine for unauthorised parking apparently it's only for permit holders and authorised vehicles. I don't know how true this is i know the first car park didn't seem to have a meter and had signs but the second didn't say anything and had a parking meter. Am wondering if because I drove in and out of the first car park they believe I was parked in the first one for the duration... any advice or help regarding the two car parks being the same different or what I should do would be appreciated unfortunately I have already appealed not reading the letter fully I automatically appealed assuming it was for not paying only to receive a reply stating it was for being unauthorised and giving me a popla reference number

Thanks in advance

Get on with drafting your POPLA appeal (and let us see it) - the NEWBIES FAQ sticky, post #3 will help you with that. Read the sticky, follow the links and use the templated appeal points as appropriate. Hopefully you'll put some paragraphing into your POPLA appeal before submitting. Many here won't plough through a wall of unformatted text.

    Date of parking event?

    Date of issue of NtK?

    Date of receipt of NtK?

Does the PCN describe the location as 'Tower Road car park' or the church? The latter is the place where permits are required, AFAIK.

Maybe your pay by phone session allocated the payment to the wrong vehicle (check)?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It all fell within the required times and I don't believe they are saying i didn't pay. I sent them a photo of the parking meter and my bank statement and they replied

I haven't provided sufficient evidence to prove I was authorised to park and it clear states on signage throughout its permit holders and authorised vehicles only.

Am not sure what the car park is called

Golf Club, TR7 1LT car park. I don't know how to upload a photo but when looking at the golf club it runs down the right hand side

Based on GSV the car park to the right of the Golf Club looks like a Pay and display.

Use tinypics, then give us the web address with "http" replaced with "hxxp". Very simple.

State exactly wher eyou were parked, otherwise we are going round in circles.

if you're using a real name for Photobucket you may want to edit it.
  • sorry I can't for the life of me upload a photo and Iv managed to do that now I can't post the URL even when I exchange http for hxxp... so if anybody has a phone number I would happily send them a photo otherwise I think I just try my luck appealing which I have to do anyway but like I said I didn't overstay or under pay it's just the argument that I wasn't authorised to park there even though there was a pay and display and the first car park said permit holders and the car park immediately to the side (aside the green) had nothing. So any advice on which sections I should copy and paste to my appral would be appreciated

That's a good link, but the point was made - is the name of your photobucket account your real name?

If so, you would be wise to create a new photobucket account with an anonymous username.
(or preferably, use anywhere else but photobucket and their horrendous pop-ups - maybe tinypic?)

Then you should delete post #7 and I'll delete the link at the head of this post.
  • Yeah it is my name... illl change the name on photo bucket but you can see the area I parked and am sure it's not part of the private parking area although I did drive through and back out of it when arriving and leaving..
