Premier Park- Offer to settle to avoid court proceedings

Hi, I've reveived a letter from Premier Park which specifies that my POPLA appeal has been unsuccessful and then offers me to pay £100 within a few days otherwise they will seek to recover the monies owed via Debt Recovery Service and may instruct their solicitor to comment court proceeding.

I drafted my own POPLA appeal from similar cases previously although I could have done a lot better.

Is my best bet to wait for a legitimate court letter? Also, I fear that I will not win my case if things do go that far so was considering paying although I am unsure if they will actually take it to court and secondly, the amount is a lot more than I can afford.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

If it goes to a debt collector, then they can be safely ignored. If you can't afford £100 if it goes to court, then you can't afford it now either, surely?

It costs you nothing to wait and see what PPL's next move is. No need to pay anything unless ordered by a Judge. You can settle at any time right up to the courtroom door. Don't panic and knee-jerk into paying right now.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Oh aren't they a generous bunch!

More bullying letters and threats to scam you out of cash, why on earth would you pay up?

POPLA isn't binding on you, debt recovery muppets can be ignored, and these are your odds of them taking you to court:
