Hi,
I just want to start by saying i am sorry for making a new thread, however i have read the entire newbies thread and am still very unclear about what i should be doing?
I have 2 parkingeye PCN's (1 2 minutes over 2 hours and the other not even sure why 1:44 hours maybe forgot to enter my pin). Now, initially i was reading some threads and people were saying ignore this, however im sure after 2012 this is not the way to go and i dont want a CCJ.
I simple want to know do i appeal to puregym first or appeal via parkingeye on their website? if so, which template (if here is one) am i to use?

Hello and welcome.
The best advice is to read post #1 of the NEWBIES FAQ sticky thread.
In there you will find a blue template appeal to send to PE.
As you have two tickets, send the appeal twice - once for each reference number.
At the same time you should complain to Pure Gym.0 -

Yes, 6/4/18 and 7/4/18, a while ago so not sure why they have just been sent to me now.0

Do both (either) Notice to Keeper (the letters from PE) include a Protection of Freedoms Act 2012 warning? It's on the second page of the letter and has a paragraph commencing 'If after 29 days.......'?Please note, we are not a legal advice forum. You are yet another person caught out at a gym. Such a disproportionate (when compared with the size of the gym industry) number of threads are related to gym parking events. Gyms are definitely lucrative honey-trap hunting grounds for PPCs.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

Then what you have are 'Golden Tickets'. Do a forum search using that term and read how to handle them via POPLA.HOW TO USE THE FORUM SEARCH FUNCTION:
Use the Forum Jump button (one near the top and one near bottom of this page) to get back to the forum thread list. Just above the threads, on the right, is a heading along a line, next to forum tools, called 'Search this Forum'. Put your key word(s) in and change the default search from 'Show Threads' to 'Show Posts'.
So it's initial appeal first of all to PE. Do 2 separate appeals as per the NEWBIES FAQ sticky, post #1. Then get your 2 POPLA codes where you will use the fact that because of their tardy issue of the PCN, they can't invoke Keeper Liability.
Take this slowly, get it right. Make sure you meet the PE 28-day deadline for the initial appeal, then you're in business once you get your POPLA codes. Don't go firing off any POPLA appeal without checking things off here first.Please note, we are not a legal advice forum.
