If I've understood correctly, because they didn't protect your deposit, the landlord will now need to return your deposit before they can issue a valid s21. That obviously will come before any rent arrears.
That said, if the rent arrears build up enough, they'll be able to evict you with an s8 anyway.0 -
It's at the judges discretion, I very much doubt you will get the full amount because of the rent arrears, in fact I very much doubt you will get anything apart from a counter claim for the arrears.0

Bottom line is you want security over your accommodation - maybe you should demand your deposit back now, move out and find more suitable accommodation then roll the dice and try and get the penalty for not protecting the deposit once you leave as this will only get worse from here.
The landlord could use the Section 8 route since the OP is in arrears, then it won't matter if the deposit is protected or not.0 -
OP, you mention DPS, have you checked the other two deposit schemes?0
