Failed POPLA - APCOA 1 letter wrong on Registration

    The RK has written a SAR to the Data Protection Officer at the PPC along the lines of the suggested content and emailed the DVLA withdrawing permission for any SAR's from PPC's as advised in the email thread.

    'Nothing will happen, ignore APCOA and complain to the ICO about misuse of the VRN data.'

    I could do with understanding the specific basis of any further complaint to the ICO for misuse of the VRN? Is this a complaint along the line of the DVLA misusing personal data or something more specific i can use against the PPC?

    There is nothing on the signs at the station and i am waiting for a response to this request, in addition to their contract between GWR/landowner, from the PPC. I will advise once i have received their response on this.
  • Wasn't there recently an edict from the BPA to its members that mistakes such as using o instead of 0 should not be pursued? I'm sure there was but can't think where to find it. Or was it a POPLA edict?

    Ahhh, well I think you could use it by analogy that the other trade body actually instructs its members not to pursue human errors of this nature - together with the point that it isn't a breach because 0 and O are interchangeable (given that O doesn't actually exist, but the numeric 0 could easily be a O) I'm not phrasing it very well, but you get the drift.


    You rely on all this to say
    1. no breach because no difference on VRNs between 0 and O
    2. if it is a breach it's de minimis (google that for more info or search for threads where it's mentioned) and the court should not be bothered with it, and the other trade body for PPCs actually instructs its members not to pursue motorists who make the error of mixing up a 0 and a O.

    I entirely agree.

    Sad that this would have been 1005 easy to win at POPLA, it's only APCOA who we categorically never see a lost POPLA appeal about on here. At least the OP knows for next time, and won't be handing over any money this time anyway.

    Just catching up with posts especially #16 & #17 regarding the O and 0 being interchangeable and have to say huge thanks as this gives me more confidence and i'm glad i didn't simply hand over the money to make them go away. I haven't heard anything back from APCOA but i will let you know when i do.

    Just suffering a similar fate to you - forgot to update Car Reg details on app so paid for wrong vehicle at Bristol Parkway. Played fair, admitted error, failed APCOA and POPLA appeals.
    Where do you get to with your appeal?
