Need advice here please!

My basic is 34k but with lots of hard work I have a gross of 40k in 2017/18 P60. Somehow my ex has hold of this information and is demanding 16% of 40k.

My questions are:
-How exactly is it fair that the CSA base on a figure that changes?
-I have my children every other weekend from Friday to Monday, I also have the pleasure of a 3 hour round trip
-Does any income she have effect the outcome of CSA?
-What happens if I change job and earn less?

    Doesn't matter if it's fair or not - the law says it's a percentage of your income as assessed.
    Lucky you, getting to see your children.
    No. It's your legal percentage contribution towards them.
    You pay the same percentage of a lower amount once they've reassessed your income.

    What did you do about the mortgage?
    Can't have it both ways (CSA/CMS and pay the mortgage) .

    Have a look at the CMS calculator to see what you should contribute.

    Have you checked how much CMS say you should pay, it depends on how many children you have with your ex and if you now have any others you are responsible for. You should also get a reduction for having the child/children for 52 nights a year. I think you can also get a reduction for your travel costs but that might depend on who decided to move, I'm not sure on that one.


    To be fair to your ex it only works out at £125 a week which isn't a fortune to house, feed and clothe a child let alone if there are 2 or 3.

    if its fair to "demand" that? how much do you think kids cost all in? it is money for them, not for your ex so why would you begrudge it? if you were in the family home you would be paying more to support them

    That's around £500 per month out of the £2000 take home, then his own living costs, and in another thread I understand he is still paying the mortgage.

    On that thread the wife was asking him to pay the mortgage in lieu of child maintenance, not in addition to.

    Your wife is correct, CMS calculations are based on actual income, so it includes anything you earn through bonuses, overtime etc.

    If you lost your job or changed jobs and earned less, you would get the assessment reviewed and would pay less.

    The assessment should take into account the number of overnight stays the children have with you. If they are with you Fri-Mon alternate weekends that works out at 78 nights per year, which would fall into the '52-104' range and mean that you would be liable to pay a little less.

    On a gross income of £40K p.a. and assuming you have 2 children and no other children in your household, that works out at about £455 p.c.m. If you have three childrne it will be around £541 pcm.

    This reads as "I work really hard for my money and I don't want my ex to have it - its not fair", "I have my children over and I even have a long journey to pick them up, its not fair"

    Well it is fair, you have them over Friday to Monday, lucky you, wish I did with mine. 3 hour journey, wow, try 7 1/2 hours each way, that is where mine are likely going.

    Be thankful for what you have, pay for your children's up keep and be happy.
