What has become of the tax, NI and any pension contributions? Is this 12K net or gross?
What should I expect back in terms of tax, NI and pension contributions?
So in summary I should:
- Get clear on exactly what the specifics of overpayment were
- Ask to pay in instalments/delay payment
- Inquire about refunds on tax, NI and pensions? (would appreciate some clarity on this one!)0 -
The holiday allowance wouldn't be the employer's mistake and shouldnt have been a surprise. The OP would have taken more that the pro rata number of days for the proportion of the leave year before they left.

£12k is a lot of money! What proportion of your salary is it? What would have happened had you not been leaving? The annual leave wouldn!!!8217;t have been an issue but the end of year bonus would have been presumably. How would they have reclaimed it? What proof do they have that there is a legitimate overpayment?
I think they wouldn't have noticed if I wasn't leaving ...0 -
I'd be checking the legal position to start with. There must be something down in the law stating whether employers are allowed to reclaim monies overpaid and giving a time limit as to how long "after the event" they can do so (if they are allowed).0

Am not sure, I will need to ask for the breakdown. Am meeting them in the next couple of weeks, they only just told me. I'm entitled to 25 days per year but they carry over, so some years I take more and others less
Also I'm really keen to understand more about what I should expect back from my employer in terms of pension, NI, etc (if anything)?0 -
I don't think that you get tax & NI back from your employer - you'll need to do a tax return.
Similarly pension - that should be being managed separate from the employment.0 -

Start with the allowance(min is 28 days) prorata for the first year.
every time you take a holiday you subtract those days.
One a year you add the new allowance.
leaving year you adjust that years allowance.

Even better where I work, we get a form with how many hours I can book and each week of the holiday year is listed, we make a note in each box for which days or weeks we want to book off, and add it up so for example I want 2 days off I put 16 in the total column for that week.0 -
