    The reason being that most people, including those very loosely deemed to be fellow claims professionals, have looked at it in exactly the same way as you did.

    The claims industry is an insular breed and in many cases it is the blind leading the blind and then things get passed on third hand.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

    Hi-

    I am new to the forum and I have joined following some mixed success in re-claiming PPI from MBNA. The policy was taken out in 2004. Following a complaint to the FOS the claim was upheld however there now seems to be problems and the FOS states that they are in 'discussions' with MBNA re policies pre 2004.

    Has anyone else faced this problem. I note that the FSA regulated MBNA since 2001.
  • I have reached a similar point as many of the previous posts in trying to reclaim PPI on a Dorothy Perkins store card taken out on 21st September 2001.

    This now comes under Santander and I have received the standard response saying it was not mis-sold because they have a signed agreement, we had 30 days to cancel, they had no obligation to record the sales process etc....

    They have then referred me to the FLA, which reading this thread sounds like a waste of time. I am only claiming a small amount in comparision to many of you c. £270 plus interest, but this is against a total balance of £370.

    Rather than waste time with the FLA can anyone recommend a firm of solicitors that would consider such a small claim? Or any other routes I could take?

    In regards of these "Single premium policies", these are the ones that have been said to have been resubmitted, so worth giving it a go.;)

    They would couple it I would think any chance. That is what they originally did with mine and its a problem also with mine now. I went for misselling originally in April, 2008, no joy as everyone unregulated at the time so I then just said unfair rebate. It was against the insurer I was told (new to me!!) and also Di the same for one of hers. I then complained about the terms of the policy also and they have now said that my complaint has three elements. I then told them I only want one outcome and it being a fair rebate from the "three" elements and they are getting the Ombudsman to look on tuesday and get back to me hopefully Wednesday next week. Its been a night mare from the start.

    hi Paolo 1980 - I have just successfully reclaimed for a PPI policy from Santander (on behalf of my mum actually). I cobbled together a very detailed letter from this and other consumer sites stating why the policy was mis-sold and requested the return of the premiums plus interest at the APR on the card (I argued that I was entitled to interest at this rate rather than the statutory 8% because the money would have otherwise been used to repay the card!). Santander totally agreed and paid (my mum) all the money claimed (about £400) plus they gave her £80 as a goodwill gesture.

    I'm happy to forward a coopy of the letter if you think it'd help.
