Returning something to ebay seller

I got sold a fake bag on ebay. The seller is adamant it's real, but it's not. He's basically sent me abusive messages for 5 days, he's used the C word among others. He's been absolutely vile. I've reported him to ebay twice, but he's issued me with the refund but I haven't even sent the bag back. I'm going to send it back but my concern is that he'll do something to the bag when he gets it back or something like that to try and get the money I paid back from ebay. Maybe you'll think I'm overreacting, but if you'd seen some of the messages he's sent me, you'd get what I mean. He is a complete nutter and messed up.

So is there anything I can do in case he does do this? I'm going to take pictures of the bag before it goes back, I'll take pictures of it in the envelop, etc., etc., but is there anything else I can do in case? I work for a law firm so I'll get one of the lawyers maybe to watch me do it all this, but just wondered if anyone has any advice? I thought about contacting ebay first to ask if I can return it via them, but then I don't know if they will do that.

    If you have a refund in your Paypal account that should be the end of it.

    Has the seller asked asked you to return it? I don't think there's any hurry to do so - it's odd that he's refunded you before receipt of the bag. Doesn't sound as though he's expecting to get it back.

    Report the messages to eBay, and if threatening rather than abusive I would consider reporting him to the Police.

    Edit - sorry, I see you've already reported him to eBay.

    You work for a law firm........less said the better.

    You have your refund, you now need to return the item to the seller.

    Then take a long hard look at the "issue".

    @Violey You've really over-complicated this for yourself. Due to the fact that eBay favours the buyers position and can't examine the goods themselves, they nearly always find in your favour (unless you make a regular habit of it). What you should have done is open a case in eBay, wait 7 days, not closing it for any reason, then escalate to eBay. Now you've closed it you going to have to follow up the PayPal case you've opened, which I've not done before as I've never used a PayPal case in such circumstances, but I'm sure it has it's own time limits for escalation. I believe the main difference with a PayPal case is that you will end up forking out the return cost, although someone on here did mention a special feature of PayPal "PayPal returns on us"

    If you are convinced that the item is fake, then contact Trading Standards before sending the item back. Selling counterfeit goods online is illegal and those who do often do go to prison. See following:

    Sorry but your wall of text is difficult to read, you might want to break it up a little.

    With a PayPal claim if you win then you are responsible for return costs unfortunately. It's only an eBay case that makes seller pay for return, so it was a shame that you closed that.

    I did open a case, but it automatically closed because he refunded me so I couldn't escalate. I just sent it through work so didn't have to pay for the return.

    I read it,it doesnt make sense because you are going off on one after getting a refund.
    Sadly fakes and sellers of fakes exist. leave a neg and get on with life
