VCS - Vehicle Contol Services

Well this is interesting:

If you're going to mis-spell the domain name for your emails, it's usually a good idea to register the "wrong" domain too. :rotfl:

I also noticed today VCS and Excel have finally put privacy notices as required by GDPR:
    http://www.vehiclecontrolservices.co.uk/privacy-notices.html
    http://excelparkingservices.co.uk/privacy-notices/

Some things that make me giggle is:
For the avoidance of doubt we are clear to advise that we DO NOT rely under any circumstances on your express consent as a reason for processing personal data and therefore do not need to request consent in advance or seek permission to do so.

I'm also amused they explicitly list out the laws they operate under:
    • Contract Law - We are able to exercise our rights to pursue a charge as derived from the Supreme Court Ruling in ParkingEye Limited v Beavis [2015] EWCA Civ 402
    • Road Traffic Regulations Act 1984 - At specific sites that we operate for Clients we issue an Excess Charge Notice, which is a provided under powers obtained through the Road Traffic Regulations Act 1984 and may result in the Driver or Registered Keeper facing criminal prosecution in the Magistrates Court.
    • Byelaws - At specific sites that we operate for Clients we issue a Notice, which is provided under powers obtained through the relevant Byelaws and may result in the Driver or Registered Keeper of the vehicle facing criminal prosecution in the Magistrates Court.
In England & Wales we also have the rights to seek recovery of any unpaid Parking Charge under:
    • Schedule 4 of the Protection of Freedoms Act 2012

No mention of Elliot vs Loake or CPS vs AJH :-)

    Blatant? Misrepresentation of authority?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes, those two sections didn't seem right to me either.
