So the end results (hopefully) was that I went to see him last night and he suggested that he would get his mate to deal with the problem for 60 pounds. I said I was happy to pay that if he was happy and he was. So the ceiling only needed a paint job with stain stuff. Thanks so much for everyone's reply!

So how did this process happen? eg: did the upstairs neighbour's insurance company pay excess?

no we had a separate buildings insurance which we all contribute to the excess was paid by the owner who's pipework caused the damage.

He came back from a big holiday to find out that there were all these brown stains on his ceiling. He also claimed a crack appeared on a beam.

How long was he away for?

As you were not negligent then you are not liable legally. Morally is a different matter.

(Unless they were away for ages, with no one checking on the house, in which case damage could have been minimised.)
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
