  • How awful for you. I would have suggested shelter too.

I have no idea about the law but if the house is repossessed don!!!8217;t the mortgage providers have a duty of care or something similar ?

They left them in the expectation that they would have use of the fitted bedroom furniture in the other house for a 2 year tenancy!
Yes, but that doesn't mean they still own their old furniture.

Phone Shelter. Obviously you need to know what to do about paying rent as well as what's happening when.

When something of value has been taken from you by deception, that's fraudulent, and the transaction isn't valid.

How much chance they have of getting it back or getting payment for it, doesn't change that.

We paid him the deposit in 2008. He never protected it.
    1) that related (presumably) to the previous tenancy. Not the one you started in April at the new property.
    2) you have 7 years to claim the penalty. There is some debate on the forum here as to whether the 7 years starts on the date the deposit was paid, or the date the tenancy ended. I do not know the answer.
  • I've spoken to my landlord today.

    He has said
Nothing is happening with the house. You're here for 2 years minimum. I asked well what about the repossession hearing on the 25th June?

    He said

Don't worry. Its just paperwork. I know what I'm doing. House is already transferred..

But surely, if he is on land registry as owner and repossession hearing is happening, he is restricted from selling or transferring?

He is just feeding me crap again isn't he ...

Agree that speaking to Shelter would be a good idea.

Useful background information about a binding tenancy.

No, there are no restrictions. If anybody were buying then (as normal) they would need the mortgage to be redeemed at completion, and he's entitled to do that whenever he wants.

It's possible he'll come up with the cash to cover the arrears at the last minute - quite commonplace for borrowers to do this.

Well he might be right. Perhaps he will pay the money owed. Or has some scheme to transfer the property to another name.

But don't rely on it - at this stage you cannot believe anything.

Go to the hearing and make yourself known to the court.

Do you have a written tenancy agreement for the new property dated April?
  • Yes

    We have a tenancy from 15th April 18 to 14th April 2020

    I appreciate all these repli3s
    Very helpful
