Hi, to put this issue in a nutshell, in the 80's a family member took his father to court for the family home. The case lasted 10 years, resulting in the son losing the case but was ordered to pay cost.
This matter indirectly led to the death of his father.
A rift was developed in the family since then and has continued. Two years ago a letter was received stating that monies was owed.by the father to Legal Aid to the sum of approximately £27K, beyond shocking. Demands were made via a collection agency. After many months of dialogue as to the origin of the debt, we received a solicitor's letter detailing the debt. Nothing was heard from them for a while, no directives
This year a letter for a court hearing was received and attended as ordered. On our return home that day, another letter from the solicitor arrived, total amount £37K approximately.
In examining all the documents enclosed, it revealed that the son did not pay the cost, so it's no charged against the property.
Also, it has been revealed that his name is still on the property although his father paid the solicitor to remove it since in the 80's.
We trying to deal with the debt as he claims he has money to clear his bill leading to the possibility of us being made home less.
Our next concern is how do we get his name removed from the property / Land Registry? No help from solicitors unless we dig deep into empty pockets.
Much in need of advice as soon another court hearing on the horizon.
Thanks in advance.

You need professional advice, as you rightly state.

Not amateur opinions from dubious internet enthusiasts responding to a sketchy explanation of an obviously complex legal issue.

"Professional" = paid for, as G_M says. All you will get on here, if anything, are uninformed opinions.

You need to pay for professional advice, this case sounds far too complicated to advise on without knowing all of the minute details.

The first thing you need to do is to work out who actually owns the property. Run a land registry search.

If the son is still mentioned as a sole-owner, you need to try and get a copy of the court order that was given in the 80s to try and work out what happened.

I do think you need a solicitor.

You could try a law centre or CAB to start with.

    Jarndice v Jarndice.

Brilliant reference... Except it's spelt Jarndyce.
