Name spelt incorrectly

Have only just noticed that my uncle's middle name has been spelled incorrectly on his will. Will this be a problem when I fill out the probate forms, as I will obviously use the correct spelling?

Thanks.

My parents (and solicitor uncle) managed to spell my middle name wrong on their wills *sigh they were the ones who named me*

Has not made any difference - asked current solicitor and she said " clerical error" - I used my proper name on probate and had no problems. Presume you have other evidence as to the spelling of his name eg passport / birth cert
  • Yes, I have a birth certificate. Thanks for your reply.

It may also be advisable to check if there are spelling errors elsewhere eg Birth Certificate, Death Certificate, property deeds, bank accounts, bonds etc. This can cause a lot of hassle and expense if you aren't aware.

For example: I was in the process of buying a probate property where there was a very slight spelling mistake of the deceased's name ('ie' instead of 'y' at the end of the first name). I had to withdraw from the purchase after 5 months of legal wrangling (and a big legal bill) as the Land Registry could not guarantee registration.
