Care Home Overpayment

Last year in December my Mum sadly passed away while in a care home. They subsequently sent a letter to say we had overpaid and would be refunding almost £1000. I didn't hear anything for a while, and having had previous issues with the finance department, I decided to write to them and remind them the refund was outstanding. I still didn't get a response, so about a month ago I wrote again, stating that this was a formal complaint (hoping that would trigger them into action, as I assumed they would have a policy for formal complaints)


That was over a month ago, and I have not received a reply. What would you recommend my next move to be? Should I write to them again, would the local authority (who part funded her care) be able to help me?

    Sorry, I forgot to mention I have done this, but still not got anywhere. Thats why I decided that writing might make it more official, as it is documented, rather than me saying I called and there be no record of that.

    Do you live near there.
    If so just call on them and dont move till you have some answers.

    Thanks for the advice. It is within driving distance, but as this is the place my Mum died, I don't think I could bring myself to visit again, it was upsetting enough visiting to remove her belongings. What is a letter before action? Do you mean legal action?

    Was there a contract because these normally seem to state 4 weeks or a month notice of leaving. This could be their excuse for not refunding.

    Yes I understand what you are saying, if someone is moving out, then there is a notice period, but in the case where someone dies, then the contract gives relatives a few days to clear the room and they 'waiver' the notice period. I had not requested the refund. It was them that contacted me by letter about the overpayment.

    Yes, letter before action (LBA) is letter before legal action.
    A solicitor will give a half hour consultation free.
