Where I live Excel leases staff car parks from the landowner, the employer pays Excel for staff to use the car park, the employer charges the employee so doesn't lose much/anything.
Technically, the employer has nothing to do with the parking and breaches of any terms.
But complaints to the employer have resulted in tickets being withdrawn/cancelled.
In this case you don't have an employer, but a commercial organisation.
You complain to head office about the fact that you as a customer were unreasonably penalised, when you did actually pay for the parking. Travelodge MAY have some sway over Excel if it is involved in the car park in some way (eg it may be the landowner).
I think you are in trouble over the not entering the full reg, because the t&cs if you buy a ticket probably say the full reg needs to be entered - you then did it through RinGo and you say the displayed terms about that didn't include the same obligation. However, Excel has pointed out that the RinGo app does tell you to enter the "accurate" reg (an ordinary interpretation of that word would be that this means the full reg). So you need to find some other arguments.
Curious that in your first post you say that the person who parked and got the ticket is a person you don't know???? I believe it is typically advised not to mention personal details and/or refer to the driver in first person.
Although I suppose that is all rather pointless, as this person has already unintentionally confirmed themselves as the driver to Excel.
I will look at similar cases via the forum to see any other valid arguments that I can use, but do you have insight and/or recommendations?0 -
Also they have acknowledged my Subject Access Request, and have asked if I would like to receive via my gmail account or via We Transfer?
I suppose there's no issue with using We Transfer?

Whichever you do, I would add that no other communications are to be sent that way and service of any legal papers is to be only by post to your current address.
The NEWBIES thread first appeal is now updated to include that, in case some PPCs decide to try serving some court claims via email, as MCOL allows now.
