I would like to take action against her employers, but I've been told to stand back because she doesn't want me to rock the boat and lose her hours.
And how does she feel about you stepping in to help with the flat? Bear in mind you can't just start dealing with these other parties without her consent.

There are x2 judgement for claimant forms with the county court stamp on it, the claim forms relate to the debt on the property. I'm really worried now because I'm not sure if my mother replied to these letters on time.
Why not? Is your mother reluctant to give you the full story, or does she just not know what correspondence she's sent to date?

Regardless of her working for an employer who pays late. They do pay so what is causing her not to.

What is she doing to help herself?

    1) I've received the documents.

It sounds like the case has now been to court with the result of the court issuing a judgment in favour of the claimant.

There would normally have been many letters before things reached that point.

It sounds like your mum has got herself into a mess by ignoring both letters and court claim forms. It would be worth her and you going down to a CAB or law centre to see if you can get some free help.

If she is able to work, as she obviously is, it sounds like she needs to change agencies so she can at least make a contribution. Otherwise it won't be £12k you are contributing, it will just keep going up.

Does she have other debts? I realise this could be caused by a nightmare contract/agency but until she gets a grip on the situation and her finances, any help you give will only sustain the situation, not resolve it.

She is ok with me handling issues that relate to the property.

I just have to keep on digging for information as I go along. She mentioned on the phone just a couple of minutes ago that the claimant mentioned something about approaching her mortgage lender, and also that she wanted me to help her fill out a N244 form.

I know she has upped her hours, which is good on her part. However, I would still like to gain a total view of her finances, as I'm not sure how much of her wages go towards settling liabilities.
I've requested more docs/ info so I won't be manoeuvring in the dark for long.

I just need to buy some precious time.
Now could I approach the council about creating a monthly payment plan for my mum, or is that option dead and buried now?
edit - I'm aware that pinkshoes & co have stated that the full amount needs to be paid off NOW - I'm just wondering if there are other options in play.

A couple of us said engage with the council earlier in the thread.

I can't see what harm it would do. I doubt the council really want to evict your mother but they, clearly, got frustrated with the lack of response (and payment, obviously) so went to court.

What have you got to lose? Just talk to them. Your mum might have to tell them that you have her authority to discuss the mater.

You need to read the court order. Have it in hand and see exactly what it says.

It sounds like your mum is giving you halve truths and drip feeding information

I wouldn't speak to the council until you know exactly where she stands and what she has received. You don't want to call them and look silly because you only have half a story

That said I think you need to get round hers ASAP assess her paperwork and call them 1st thing tomorrow.

All providing she is willing to let you of course
