Smart Parking

I parked in a Smart controlled car park using a Blue Badge thus enabling a badly disabled elderly relative the dignity of collecting her own medication for advanced stages of cancer. I have been issued a parking charge for not buying a ticket. The appeal result has not been issued yet but based on what I am reading, there is not much compassion from Smart Parking. Anyone else had experience of this ?

This is private parking land it's greed based not compassion based.

You should also be aware your blue badge is not valid on private land (only as an unofficial notification) and certainly does not entitle you to free parking.

I assume you appealed before reading the newbies thread, which is where you should now research.

You will get a POPLA code with your rejection use it wisely unfortunately you have probably used up some of your lifelines if your appeal was not guided from this site.

Smart are not particularly litigious though.

gosh ... you are in for a rude awakening

even our MP's think so ......

    watch/ read

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

The appeal result simply gives you a POPLA code.

Then yes, we almost always win at POPLA. That's what the NEWBIES FAQS thread is about, third post of it has POPLA templates but you can just as easily find several examples, by searching the forum for:

    Smart POPLA ANPR surveillance camera

and one of the first ones you find is on a link here in his 12th post:

26 pages long, that one! LOL, Smart don't like looong POPLA appeals!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
