It might be simpler just to get two quotes; send them to the tree owner saying it has caused damage and give them 14 days to pay the lower of the two quotes or you'll begin legal proceedings. Then either:
1) They pay up
2) They send to their insurers
3) They do nothing and you commence a small claim (up to £5000); then if it goes that far a judge will decide who pays. I think you would win the claim easily.0 -

I will do just as you have advised...i have a arborist i can ask to do a report and can easily get a couple of firms to quote for brick work,as you say they can either pay (assuming report supports what i say) or go to court.
