Delay in getting Help to Buy ATP yet exchange date is 19th May

Hi All,

There's been a delay in getting my HTB Authority to Proceed. Part of it appears to be incompetence of mortgage advisor. They have been sending the form to the help to buy authority with inadequate information and it's been returned on 3 occasions. The ATP finally got issued on Tuesday, then it transpired that the broker had put in the incorrect mortgage amount and had to request another ATP, which will be issued this coming Monday or Tuesday.

The solicitor I have hasn't been communicating with me much so I've been groping in the dark trying to understand what's going on. All I know is that the searches are done.

The last I communicated with the solicitors, they said that they were waiting for the ATP before they could proceed to the next stage.

My exchange is due next week on the 19th and Bellway homes reserve the right to remarket the property if the exchange doesn't happen.

My question is: If ATP gets issued at the start of next week, will that allow enough time to exchange by the 19th? I'm really in the dark about what'a going on and my solicitor is unrelatable. I was told that it's good practice for the solicitor to contact me at the start of the process to take me through the process and tell me what's involved. She didn't even do that.

The solicitor was suggested by Bellway Homes as they are on their panel and the broker was also their recommendation.

If it all fails and Bellway decides to remarket the property, could I hold broker to account in some way, especially given the delays that have been caused by their admin's incompetence?
