Financial Hardship, Then or Now?

Apologies if this question has been answered before but if I consider my circumstances 15/20 years ago then yes I would have been in financial hardship... but not currently, so is the term "in financial hardship" relating to the present day? Can I still make a claim for a period where I believe bank charges were detrimental to my then circumstances?

The Banks won their court case on "unfair" charges in that year, so now you are NINE YEARS too late to the party.
