UKPS - Next step?

I received a PCN from UKPS and sent them a copy of the letter on the Newbies forum here. I received the following in repy and wondering what to do next?

"Dear (name removed by me)

Thank you for your recent communication concerning the above Parking Charge. Please rest assured that our Appeals Manager has personally reviewed this case and carefully considered the various points raised. Their view, however, is that the Parking Charge is neither unreasonable nor unjust and so we will not be waiving this parking charge.

I understand when receiving a Parking Charge Notice its natural to look online for help, which by looking at your cut and paste letter that is what you have done. All these letters do is give the motorist false hope but escalates the charge from the reduced rate of £60 to £100 charge or even more.

If you try to look at it unbiased and logically if an uninvited motorist came to your house and parked on your drive way or in your allocated parking bay you would not be happy? It is the landowner right to protect his property and if drivers park and do not comply with the terms and conditions they may be issued with a PCN. The operative witnessed that you parked you vehicle and Left outside a unit at Rowley Green that needs access to his premise at all times, the operative observed the vehicle for over 5 mins and issues the PCN.

I see that the charge has gone up to the £100 charge however, UKPS Ltd is still trying to resolve the situation and still will to accept the reduced rate fee of £60, this offer is available for the next 9 days after which it will revert to the balance without the price reduction.

All of your questions from the letter are either answered in this letter or you can view the photos taken of the incident online which the url address is further down.

The contract that UKPS Limited has with the owner or occupier of the land (which authorises UKPS Limited to enter into a contract with the driver requiring the payment of Parking Charges in respect of parking of the vehicle on the land) contains a confidentially clause and as such we are not in a position to provide the contract to you.

As a member of the Approved Operator Scheme, UKPS Limited are audited by the IPC to ensure that we have all relevant contracts in place. UKPS Limited will provide the court with a copy of this in full if they require it, or can provide a written statement to this effect from those party to the contract. We are also more than happy to provide confirmation to the independent assessors that we are authorised to manage parking at this site. We can confirm that parking management at this site has been contracted to UKPS Limited.

All of our signage is fully compliant with the guidelines set our within the IPC Code of Practice and we reject the notion that it is in any way unclear or ambiguous.

The highest court in the UK, the Supreme Court, has unambiguously confirmed that parking charges issued on private land are fully enforceable. In the case of ParkingEye v Beavis (2015) UKSC 67 their Lordships stated that private parking charges were enforceable because they served a legitimate interest and were in the interests of the public generally. The case confirmed that the amount of the charge does not have to reflect any loss that might have been caused by breach of the terms and conditions of parking.

The Supreme Court decision is binding law on all other courts throughout the UK.

We appreciate that this is not the outcome you will have hoped for. Unless you have any additional information that you have not already brought to our attention this decision is final.

In light of the contents of this letter you now have a number of options:

1. Payment offer of reduced rate for the charge above at the reduced rate of £60; to UKPS Limited. PLEASE REFER BELOW FOR PAYMENT OPTIONS AND ADDRESS DETAILS.

2. If you are not happy with our decision you can contact the IAS (link removed) standard Appeals service within 21 days of this appeal being declined.

By law we are also required to inform you that the Ombudsman Services (link removed) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to IAS, as explained above.

3. If you choose to do nothing the parking charge will automatically increase after 9 days from the date of this letter to £100 and the matter will be passed to our debt recovery agent, at which point you will be liable to pay an additional charge of £60, in accordance with our terms and conditions of parking and further charges will be claimed if Court action is taken against you. Any unpaid Court Judgement may adversely affect your credit rating.

PLEASE DO NOT IGNORE THIS LETTER, UKPS LIMITED REGULARLY TAKES MOTORIST TO COURT WHO IGNORE THEIR PARKING CHARGES.

    Not sure why you've shown an IPC rejection letter like everyone gets from any IPC firm. And obviously we know about the Beavis case which is nothing like your case if the car was only stopped for 5 minutes, and not at a retail park.

    NEWBIES FAQs thread tells you there is no appeal but that we win 99% of cases if a PPC tries a small claim letter.

    No risk, no worries, no CCJ, as long as court papers/directions and deadlines are not ignored.

    This is hilarious and desperate!

  • i've had a Parking Charge Notice off UKPSS Leaminton and have read all the threads but remain confused.
    the car is leased. UKPSS have obviously contacted the lease company via DVLA who have then passed them my personal details as keeper. UKPSS refer to me as the registered keeper although there is a very fine note right at the end stating that my details were obtained off the lease company.

    UKPSS claim £100 discounted to £60 if paid within 14 days for the offence of "permit required"
    there is no evidence of a ticket having been applied to the car, although one would definitely have been purchased by any driver and valid, there is no picture of the car parking ticket purchased and placed on display, evidence of how long the vehicle was there, or evidence of the location of the warning notices. the notice is issued some 5 weeks after the date of the claimed offence.

    so, in view of the leasing company contact, am I being treated as the registered keeper?

    they claim they are under International parking Community's code of practice - so are they out of date (14 days to notify keeper by post) - or do they get longer as they've gone via the leasing company ???

    i am given the option of pay at discounted rate within 14 days or appeal within 21 days and thereafter to IAS if declined.
