Hi! Please could you help me?
I have a PCN and now a PCN reminder letter form Total Parking solutions re an overstay of 56mins at a retail carpark on 07/04/2018.
I received the reminder today, can't remember when I received the PCN but issue notice date was 13/04/2018.
I have ignored both letters so far. The PCN said I had 28 days to appeal. I have not appealed.
A photo of the car entering and exiting the car park is included done by ANPR.
The firm are BPA members.
I have seen a template on the newby page which looks suitable. Are you able to advise me please? I am fed up with these people.

yes use the template appeal, not on any "newbies page" but the one in the NEWBIES FAQ sticky thread at the top of this forum, second one down , post #1 , appealing as keeper and copying the template verbatim, no additions or subtractions , nothing at all

edit post #1 and remove your name and any hint of who was driving

in future, DO NOT IGNORE private parking charges, follow that NEWBIES FAQ sticky thread to the letter

I have submitted the letter, thank you. Let's see what happens next.
It said this once I had submitted the letter online: (Thought I would keep a record of everything just in case...)
    Appeal
    Your appeal
Thank you for your email; this is an automatically generated response, your appeal has not yet been read.
*Please note: Appeals must be submitted within 28 days from the notification to driver/keeper and if received outside of the applicable 28 days (as per the appeals procedure) your appeal will not be accepted*
For appeals received within 28 days, we will halt any further action until we have responded to your appeal and advised of our outcome.
In order for us to respond to your appeal, it is essential that you provide us with your Parking Charge Notice (PCN) number along with any supporting evidence. Upon receiving this information, we will halt any further action until we respond to your appeal. If your appeal does not contain this information and was submitted within 28 days of the keeper/driver notification, please resend an email ensuring your PCN number and evidence is included. We aim to respond within 35 days of receiving your appeal. If we decline your appeal, we will supply you with the contact details for Parking On Private Land Appeals (POPLA) - the independent appeals service.
If you were not the driver at the time of the Parking Charge Notice issue date, please provide us with the driver's full name and address so that we may transfer liability. (Then info on how to pay etc.)
If your appeal contains a Section 10 Notice under the Data Protection Act 1998, please send your Notice to the email address. (not allowed to post it)

Hi again. My reply from total parking solutions is below. Sounds like they mean business! Please could you give me some advice? I would be very grateful, thanks.

Thank you for your correspondence, the contents of which have been noted. Unfortunately, after careful consideration your representation has been declined. It follows therefore, that the Parking Charge Notice was correctly issued and the discounted amount of £40 remains outstanding. You have now reached the end of our internal appeals procedure and you have a number of options; 1. If you were not the driver, please provide the full name and serviceable address for the driver. 2. if you were the driver, pay the Parking Charge Notice within 14 days at the prevailing price of £40 by 29/05/2018. Please note after this date, the full charge will be due at £70 and must be paid by 12/06/2018. Payment can be made online ... or via our 24 hour telephone line 01536 680107. Payment can also be made by post to TPS UK, PO Box 7135, Kettering, NN16 6BP. 3. Make an appeal to the Independent Appeals Service (POPLA) within 28 days (by the 12/06/2018) by visiting ... and use the following verification code ... to submit your appeal. Please be advised that if you choose to have independent arbitration of your case, and your appeal is declined, then the Parking Charge will be due at the full amount of £70 4. If you choose to do nothing, we will seek to recover the amount due via our debt recovery process, where additional costs may be incurred. By law we are also required to inform you that Ombudsman Service ...provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA, details on how to are explained above.

you do not name the driver

you do have a POPLA code so YOU construct a POPLA appeal based on the information in post #3 of the same NEWBIES FAQ sticky thread you were referred to earlier (same as we tell everyone else who have a pcn from a BPA member)

it tells you to appeal to popla in the latter half of your post above

I would be scared , very very scared , (not) please send a good POPLa appeal as this will cost them £25 to defend , debt collection charges are not enforcible in county court

will cost him £200 + to get £45 back (70 minus popla fees )

POPLA time. As you should have been expecting, and are ready for, having read threads like yours.

So go and read post #3 of the NEWBIES thread, and also search the forum for ICO Code ANPR surveillance camera POPLA to find recent ones which include that specific ANPR issue.

Show us your draft like everyone else does, you have a month.
