Well, that's the same logic I apply to this whole argument otherwise it is ludicrous. It states that you must be 18 or over to register and enter into contract bidding on eBay. If you are underage and still go right on ahead and register anyway and you subsequently win on auction for say an 18 certified DVD you have chosen to bid for, how the Hell can that by the seller's fault? Surely the registration under false prentences is the over-riding offence. The seller should not have to be placed in that situation and having to verify the ages of all his/her winning bidders when they really all ought to be at least 18 according to the registration prerequisite.
You could probably come up with a silly scenario where someone deliberately sells an age restricted product to someone under age via EBay to cover themselves. For example you could sell age restricted games/dvds to a young neighbour via their parents' or a fake Ebay account.
Given that most payment is via credit card via Paypal you have an extra two layers there. If you received payment via post with a load of loose change you may need to check it isn't some kid sending pocket money.
All that said, you'd probably have to have at least half a dozen reported cases before anyone took any notice let alone prosecute. Trading Standards occasionally set up stings but that's usually in bricks and mortar shops.

Been in touch with eBay tonight via online chat. They state that it is NOT the seller's responsibility to verify age because the registered member should be at least 18 years old anyway. They are the offending party and have deceived the seller as a result. :)
