POPLA appeal for Premier Park PCN
Comments
-
After submitting the appeal with Coupon-mad's changes I received an email from POPLA saying that Premier Park has now uploaded its evidence via their portal and that my comments are required.
The "evidence" that Premier Park has submitted looks to me as a massive template copy. They have attached a PDF file with all the website communications we had as well as an excessive amount of photographs from the parking site and have also copied the text on the body of the reply.
There are however some points that might be specific for my appeal such as the following:
- The Appellant has not denied that the driver did not see said signage.
- The photograph of the entrance to the car park submitted by the Appellant within his POPLA appeal is not date and timed stamped and therefore, it cannot be confirmed when the picture was taken. Therefore, it cannot be considered as part of the appeal.
- With regards to the appellant’s remarks that the parking charge notice is punitive and unreasonable and not a genuine pre-estimate of loss, we...
In their last point they refer to "the appellant’s remarks that the parking charge notice is punitive and unreasonable and not a genuine pre-estimate of loss" while I haven't made any such remarks on my appeal! This looks to me disrespectful both to me as well as to POPLA.
They have also scanned and inserted in the PDF the agreement they have with the landowner. You can see this section extracted here:

It does look like they have only tried to cover the first 2 point of my appeal and I cannot see anything about point 3 Failure to comply with the data protection.
Any help on how to proceed from this point onward?0 -
You will find plenty of helpful threads by searching for the most obvious keywords:
POPLA comments Premier Park
That will show you what to write at this stage: bullet points about the sign age evidence (old or undated photos?) and how heavily redacted the contract is, such that it does not comply with para 7 of the BPA Code of Practice.
...and if you lose, as plenty do against PP, and then just ignore them happily, search:
POPLA lost Premier ParkPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think I might have missed the deadline for submitting my comments as I can't see where I can do this in the "POPLA Track Appeal" page. The status shows "In Progress".
The newbies thread says "YOU REALLY MUST COMMENT" so is this all over now that I haven't submitted mine?0 -
What is the date of the email from PoPLA inviting your comments?
If you have missed the boat then re-read post # 13 to see what's next.0 -
Hi guys, first time posting so please forgive me if I ask anything stupid or leave out vital detail.
ive just received a final reminder from premier park and I’m trying to find a way just to simply speak to someone there! My partner and I broke up a while ago and since then I pop back once a week to grab my post, however I’m December I had to undergo chemo and was stuck indoors for 3 weeks and unable to collect my post as usual. So, premier park has been sending me letters that I hadn’t received due to being on treatment. I am now landed with £115 bill rather than the usual £60 due to not paying on time, due to no fault of my own.I’ve tried to appeal but the website basically says that because a final reminder has been sent I am unable to appeal. So frustrated with this whole process and just looking for a little help.
thank you0 -
