Council tax summons 2018/19 already!

Advice please. I have previously been un arrears for ct for about 5 years (never more than 300) and finally caught up on 1st April. I then got a reminder for this years 1st installment on 15 april. Today i now got a magistrates summons dated 4 may for whole year plus 100.00 fee!!! and are demanding arrears and fees to avoid action.
Firstly can they do this just 4 weeks into the new rax year?
Secondly i only got one reminder and thought they had to send at least 2?
Who decides the summons fee? I saw another thread where Preston council fee was £ 32
The summons fee is calculated by the council but approved by the court. The same applies for the liability order fee.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
I thought this was an advice forum not an attitude forum..i am on pension credit due to low income and this ripoff tax is 20% of my monthly income and is about the same as i spend A MONTH on food so lose the attitude miss
Its you that has the attitude imo.
As soon as you say 'rip off tax' its clear that you are in arrears to an extent intentionally, not just due to circumstance alone...0 -

Paying in monthly instalments is not a right.
If you miss an instalment you lose the privilege of paying in instalments and have to pay the annual amount in one payment at the beginning of the year.0 -

When did you intend to start paying this year's council tax?
FTR, I don't see any attitude in pinkshoes' post.
Basically, she's saying she can understand why the Council have acted as they have.
And so can I.

I dont think my response to pinkshoes was unreasonable considering her opening comment was ".... in arrears ALREADY" . I both accept advice and give advice on many topics but never prejudge anyone. As explained in my post i caught up on 1 Apr (from Mar pension so didnt get paid again till last week)
My surprise as to the quickness of the council action is the main concern considering they have. For at least 5 years allowed a (reducing) arrears for that whole period and it feels like i am being punished for catching up again.
I will have to see what they say after the bank holiday..0 -
You might try asking your council for a discretionary award to cover your council tax liability.

But pinkshoes' comment was actually reasonable - whether you think it was or wasn't - as you are in arrears at the very beginning of the CT year. i.e. ALREADY.
But shall we agree to put that on one side?

I've never been in CT arrears but my elderly Mum & Dad did receive a very nasty letter probably similar to yours in May one year.
It was a council error as they'd not carried the DD over from the previous year.
Perhaps your council might have cut you a bit of slack if you'd actually contacted them and explained your circumstances. I don't know how CT arrears work.
Maybe Mattyprice can come back and explain how he solved the same issue.0 -
